i dont know if nintendo would set wifi multi player games to allow two identical charecters to go up against each other, they may program the game so that each race has one gamer per charecter

I play People all the Time on Mario Kart: DS Wi-Fi, who chose the Same Racers as Me. If you remember, we are distinguishable by Our Custom Icons, which I'd expect in the Wii Mario Kart.

In Smash this is important because we all see the same battle arena with all the characters mixed up. All players share the same camera view.
In Mario Kart you have your own camera view focus on your character and kart. Why would you confuse your kart (centered on your camera view) with a similar kart 3 spots away?

"but what did happen in MKDS when two or more people had the same characters?" Nothing. It's very easy to tell the difference between you and your opponent.

so, just because they helped with sluggers doesn`t suggest for a second that namco are going to allow their charecters to be in future nintendo games. it is possible that namco could license there charecters to nintendo, but highly unlikely, as nintendo have always produced the home versions of mario kart on their own.
if you want to play as pacman in mario kart, i suggest you fly to japan, and go to a games arcade, because thats the only way you`ll get to play them in mario kart.
